NSW Legislation

In NSW, there are laws for buying, selling or leasing a property with a swimming pool.

When selling or leasing a property with a pool you must have a certificate of registration and either of the following

  • A certificate of compliance
  • A relevant occupation certificate
    (remains relevant for 3 years from date of issue)
  • A certificate of non-compliance (option only when selling)

Certificate Validity

A Certificate of Compliance remains valid for 3 years from the date of issue. If someone purchases a property that has a Certificate of Non-Compliance, they have 90 days from the date of settlement to rectify the defects.

Compliance Inspection

Prior to an inspection being completed or a compliance certificate issued, the swimming pool must be registered on the NSW Swimming Pools register. The Registration can be completed at: www.swimmingpoolregister.nsw.gov.au

Only Registered Certifiers who have been nominated on the Swimming Pools Register can complete inspections of Swimming Pool Barriers.
